Lyon Township went from about 14,500 people in 2010 to over 20,000 by 2020 — roughly 40 percent growth in a decade, several times the rate of its neighbors. Oaks Are Landmark Trees at 18 Inches
Lyon Township's landmark list runs by species — oak, maple, beech, hickory, pine and tulip poplar at 18 inches DBH, black walnut at 20, sassafras at 15, and dogwood, redbud, serviceberry and blue beech at just 8. Landmark trees carry the heaviest replacement obligation in the ordinance, at one caliper inch planted for every inch removed.
Oak Wilt Has Hard Dates
Michigan DNR guidance is not to prune oaks between April 15 and July 15 — sap beetles carry the fungus into fresh wounds, risk peaks in May and June, and red oaks can die within weeks. Between that and the 18-inch landmark threshold, oaks are the highest-stakes tree in New Hudson both ecologically and legally.
Ash Isn't Protected at All
Every ash species — white, black, green and blue — sits on Lyon Township's nonprotected list, along with box elder, tree-of-heaven, Siberian elm, black locust, buckthorn and the willows. Dead ash from the emerald ash borer can come out without the ordinance getting involved. It's still brittle and dangerous to climb, so we work it from outside the tree.

New Hudson Tree Rules — It's Lyon Township's Ordinance
New Hudson is an unincorporated community, so Lyon Township's Tree Protection ordinance is what applies. It's stricter than most, and how many trees you take matters more than you'd think.
A Protected Tree Is 8 Inches or More
Any tree 8 inches DBH or greater that isn't on the nonprotected list is a protected tree, and it's unlawful to remove one without a tree preservation permit — subject to the homeowner exceptions below. DBH is measured four and a half feet above grade.
In a Subdivision: No Permit, But Count Your Trees
On an established lot in a subdivision or site condominium, no permit is required. But removing two protected trees in a rolling twelve months carries no replacement obligation, while three or more does. That threshold catches people who take out a few trees over one summer.
On Acreage: Replacement From the First Tree
Outside a subdivision, no permit is needed up to ten protected trees in twelve months — but replacement applies starting with the first one. At eleven or more, you need a permit. Replacement is capped at five trees per platted lot.
Dead and Damaged Trees Are Exempt
The ordinance says it plainly: a permit is not required for removal or trimming of dead, diseased, or damaged trees. Emergency work after a tornado, windstorm, flood, freeze, or insect infestation is also exempt, with the township supervisor determining whether an emergency exists.
Removing Trees Without Authorization Gets Expensive
Illegal removal carries a civil penalty equal to the full value of the trees, computed from the International Society of Arboriculture shade tree value formula, paid into the township tree fund — or inch-for-inch replacement instead. Violations are a nuisance per se and stop-work orders are enforceable in Oakland County Circuit Court.
Trees Being Kept Get Protected
No construction activity, storage, solvents, building material, equipment, or soil deposits within the drip line of any protected tree designated to remain. If you're building and want a tree to survive it, that drip line is the whole ballgame.
The Road Right-of-Way Belongs to the County
The Road Commission for Oakland County owns all non-public-private roads in Lyon Township, and a permit is required to work in the county road right-of-way. Township ordinance also bars removing a right-of-way tree unless it's replaced there.
